These terms form an agreement between you and Project 24 INC, trading as Project 24 Paddock ("we", "us"), the provider of the Project 24 Paddock telemetry coaching software (the "Service"). By creating an account or continuing to use the Service you agree to these terms. If you are signing up on behalf of a team or business, you confirm you have authority to bind that organisation; otherwise you confirm you are of legal age to contract.
The Service
Paddock lets coaches import lap telemetry and GPS traces, annotate specific corners, and share that feedback with their drivers. Drivers can review sessions, flag corners and reply. Access is granted as a limited, non-exclusive, non-transferable right to use the Service within the plan you have selected.
Your account
- Keep your credentials confidential; you are responsible for activity under your account.
- Provide accurate information and keep it up to date.
- Only share driver pairing codes with the drivers you intend to coach.
Acceptable use
You must not misuse the Service. In particular, you must not:
- use it unlawfully, or for fraud, spam or harassment;
- upload data you do not have the right to use, or infringe anyone's intellectual property;
- interfere with security — no malware, probing, scraping, or circumventing plan limits;
- reverse engineer, resell or redistribute the Service.
Your data
You keep ownership of the telemetry, notes and other content you upload. You grant us a limited licence to host and process that content solely to provide the Service to you and the drivers you share it with.
Intellectual property
We retain ownership of the Service, including its software, analysis tools, documentation and branding. No rights are granted other than those expressly set out here.
Service level
We work to keep Paddock available and accurate, but the Service is provided without a guarantee of uninterrupted or error-free performance. To the fullest extent permitted by law we disclaim all implied warranties, including merchantability and fitness for a particular purpose. Telemetry analysis is a coaching aid: you remain responsible for on-track decisions and safety.
Payment, subscriptions and taxes
Paid plans are billed monthly in advance. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation and refund mechanics are governed by Paddle's Buyer Terms together with our refund policy.
Upgrading a plan takes effect immediately and is charged pro rata. Downgrading takes effect at your next renewal. Cancelling keeps your plan active until the end of the paid period, after which the account returns to the Free plan.
Suspension and termination
We may suspend or terminate access for material breach of these terms, non-payment, security or fraud risk, or repeated or serious policy violations. On termination you may export your data for 30 days, after which it may be deleted.
Liability
To the extent permitted by law, our aggregate liability is limited to the fees you paid in the 12 months before the claim. We exclude indirect, consequential or special damages, including loss of profits, data or goodwill. Nothing here limits liability for fraud, death or personal injury where such limitation is not permitted.
You agree to indemnify us against claims arising from your content, your unlawful use of the Service, or your breach of these terms.
General
You may not assign this agreement without our consent; we may assign it in connection with a merger or acquisition. Neither party is liable for delays caused by events beyond reasonable control. These terms are governed by the laws of the seller's jurisdiction, and disputes are subject to its courts.
